According to reports we look likely to pay off Dele Ali's contract this summer in order to not pay spurs the £40 million pounds, must be the worst waste of cash ever on a player.

They can just add it to the list Ed002. Its a shame consumer laws don't apply to football we could have sent all our duds back as not fit for purpose and got a refund.

How come its not a option Ed? Are we obliged to play him x amount of games? Surely if we are paying his wages and his form/ antics dosent warrant a place then we ain't doing owt wrong are we?

Very surprised it can be deemed constructive dismissal ed. If scenario is we carry on paying his full wages and he ain't picked due to his poor performances/ attitude, get there is a duty of care but dele alli was at a lost before he came to us and we have acted fairly in giving him a chance to resurrect his career but due to his lack of form/ personal issues which seem pretty edivent to all we are lumbered with a £200k pw (rumoured) liability who if your correct we hsve to be seen involving even if unwarranted. Totally bizaare and complete mess by the hierachy.

What would happen if Dele just said had enough of football& retired?

The point is that if Everton are going to deliberately not play a player because his transfer fee will not cover the money they want to try and rip off another club for then it will be a big issue. Alli is contracted to Everton and won't be looking to retire.}

So what happens if an internal review of his behaviour, by Everton, deems that he has conducted gross misconduct, failed to maintain and, or he has breached his contract, and, or brought the club in to disrepute.
Surely, simply employment law will allows for dismissal, through accumulation of offences.
While voiding any deal with Spurs, and requiring them to get reimbursement from Dele, for losses if they wish to.

Are you saying that
1. there is a clause in the contract that requires payment to Spurs irrespective of games played? Or

2. that not playing Dele would be considered a deliberate act to avoid paying Spurs any money due to the fact that payments are dependent on appearances?

Because I could understand the first point if a payment was due regardless of appearances but surely if its the second point I don't see a court could judge that the only reason Ali isn't playing is to avoid paying any fees to Spurs. Its plainly obvious that he isn't good enough to get into any Premier League side at the moment. Even a side struggling like we are clearly don't deem him good enough. Cenk Tosun couldn't get into our team and he has scored 15 goals in the Turkish League. Dele Ali has scored 2.

{Ed002's Note - The clauses are complex and there are clauses related to payments associated with games, payment associated with selling the player regardless of games and if Everton intend to run his contract down to rip of another Premier League club both the player and the club will have the opportunity to go to court to seek recompense from a club trying to cheat.}

Thanks ed for all your knowledge and advise. The main problem is trying to negotiate a deal with Mr Levy. I think we stand a better chance putting a head in a bears mouth and coming out without a scratch than making a deal with him that is fair to all parties rather than EFC getting severely mauled once again.

Ed002, I understand the concept that Everton may try to be pulling a smart one by running down his contract. At the same time that seems very unusual like the whole deal.

In a way that sounds like Everton are under an obligation to play him. Like, it's obvious that he appears not to be of the standard to get in the team, yet Everton have to play him to suit either Spurs or the player.

It's pretty bad when he can't get into the team. Is the players discipline not questionable? Obviously I don't know that for fact but it comes across that way with the ever unreliable media coverage about him.

Sounds like it was a win - win for Spurs no matter what happened. I totally get and agree it is Everton F. C. and only Everton F. C. 's fault the situation they find themselves in. So I'm not surprised with what your saying. It adds to the long list that makes the club look ridiculous.
